No figure where the tribunal has fewer than 40 decisions with a known outcome that year: the Canary Islands tribunal publishes on its website from 2022.

What reaches the courts

Very few decisions are challenged, and almost all are confirmed

Of the 29,470 decisions, 377 are cited in 314 judgments of the administrative courts. In only 82 cases the judgment has the decision as the act under review, meaning someone took it to court. In the rest, the judgment merely relies on it.

Who reviews

  • Regional High Courts 69
  • Supreme Court 9
  • National High Court 6
  • Administrative courts of first instance 1

How it ends

  • Decision annulled 12
  • Partly annulled 8
  • Decision confirmed 44
  • Outcome not yet identified 18

Of the 64 reviewed decisions whose judgment has an identified outcome, 44 were confirmed and 20 were annulled. The sample is small and does not support rates; it does support saying that the special appeal is, in practice, the last word.

Methodology

Where the figures come from

Source

The decisions each tribunal publishes on its own website: the central tribunal (TACRC), Andalusia, Madrid, Catalonia, Galicia, Castile and León, the Basque Country, the Canary Islands, Aragon and Navarre. The provincial body of Gipuzkoa does not publish its decisions in any accessible list and is left out. The ten regions without a tribunal of their own are heard by the TACRC under agreement, and their appeals are included in the TACRC figure.

Period

From 1 January 2020 to the latest decision published by each tribunal at the time of calculation. Each tribunal's cut-off date is in the downloadable table.

The outcome

Nine tribunals publish it as a data field. The TACRC does not: in its decisions it is read from the operative part (ACUERDA / RESUELVE). The procedure was checked on a random sample across all years without a single error, and its result matches the TACRC's own official statistics, which for 2025 report 15.85 % of appeals upheld and 6.59 % partly upheld, 22.44 % together.

Categories

Upheld: the tribunal grants everything the appellant asks. Partly upheld: some of it. Dismissed: the tribunal reaches the merits and rules against. Inadmissible: it does not reach the merits, usually for lateness, lack of standing or because the act cannot be appealed. Withdrawn: the appellant withdraws. Rates are computed over decisions with a known outcome, with withdrawals excluded from the numerator.

Coverage

Not every decision has a known outcome: some are published without full text, or with an operative part that fits none of the categories above. Catalonia and Aragon are below 80 %, and their rates are given with that caveat.
